THE operators of a mobile phone text scam that preyed on the desperate and dateless were yesterday slammed with $15.8million in fines for breaching anti-spam laws.

The fine, from Queensland’s Federal Court, makes the operators — who posted fake personals profiles on dating websites to harvest mobile phone numbers and lure men to pay up to $5 per message for SMS sex chat services — the recipients of Australia’s largest spam penalty.

It trumped the West Australian Federal Court’s October 2006 imposition of $5.5m in fines against email marketing company Clarity1, of which $1m was levied against managing director Wayne Mansfield.

It was also the first time the Australian Communications and Media Authority had taken legal action over SMS spam.

China gets a bad rap as the major source of source of spam, according to statistics analyzed by Microsoft email security researcher Terry Zink, who points out on his anti-spam blog that the U.S. is the “spammiest” country, pushing out nearly one-third of all junk emails.

But measuring the total amount of spam coming from different countries may not be the best way to determine how “spammy” a country is, Zink observed.

It’s no wonder that spam senders stay active when so many are falling for their schemes

“Don’t click the spam… Don’t click the spam…” — perhaps that should become a mantra for internet users in the U.S. and Canada. A new study (PDF) showed appallingly that one in six users responded to an email posing as spam.

The study was conducted by the Messaging Anti-Abuse Working Group, an anti-spam trade organization, and shows just how gullible many everyday users are.
